Prosecutor General Lee Won-seok delivered a guideline to the prosecution office on the 4th to take strict action against illegal filming crimes that occurred in public toilets.

President Lee ordered, "In principle, illegal filming crimes in public toilets should be referred to the court (formal trial) even if they are first-time offenders, but the arrest investigation should be actively considered in consideration of the details and methods of the crime, the presence or absence of a criminal history of the same kind, and the number and duration of the crime."

President Lee also recommended applying this as a weighting factor for sentencing factors and reflecting it in the sentence, and actively responding through appeals if the sentenced sentence does not meet the sentence.

In addition, he ordered the Supreme Prosecutors' Office to request the cyber and technical crime investigation department or the digital sex crime victim support center to remove and block illegal filming if there is a concern about the distribution of illegal filming to protect and support victims.

According to the Supreme Prosecutors' Office, the majority of illegal filming takes place by breaking into the women's restroom and pushing their mobile phones up or down the toilet.

The crime site occurred not only in commercial toilets such as bars, cafes, and restaurants, but also in schools, workplaces, train stations, and airports, and there were cases where the victim was a man.

The main sentencing factors considered in the sentence of the ruling were analyzed as the presence or absence of the same crime history, the number of crimes (number of filming) and the period.

The Supreme Prosecutors' Office said, "Illegal filming in public toilets is a deliberate and planned crime committed by breaking into toilets, and even first-time offenders are at high risk of leading to subsequent crimes such as additional sex crimes and dissemination."
